Agreement for the use of our designs:
Please read carefully our little bit
of "legal jargon" put together by my husband, our legal
advisor.
All our designs and images are
copyright by Retro Boulevard Designs and/or Ytmar Santiago and
are protected by the United States copyright laws and
applicable international treaties. Purchasing of our
designs grants you a user license. I retain complete ownership
of the design as well as the images and graphics, unless
otherwise noted. You may not copy these designs except to make
one copy for yourself as a backup or archival purposes.
Buying, selling, trading or transferring copies of our designs
is a violation of copyright law. By copyrighting our designs,
we are protecting our best interest as well as yours as a
consumer of our goods. We enforce copyright laws and will
legally pursue copyright violators.
In the event you receive a defective
design, either by email, download or disk, Retro Boulevard
Designs and/or Ytmar Santiago's liability and your exclusive
remedy for such defective product shall be the replacement of
the design. In no event shall Retro Boulevard Designs and/or
Ytmar Santiago be liable for any consequential damages,
including but not limited to loss of materials, business
interruption, loss of profits, etc., arising out of the use or
loss of use of the design, even if Retro Boulevard Designs
and/or Ytmar Santiago have been advised of the possibility of
such damages.
If an emailed or downloaded design is
not defective, per our own determination, we reserve the right
to charge a nominal amount to resend the same design which
will not exceed $5.00. If you are unable to receive the
designs by email due to your own ISP provider, we will charge
$5.00 for every time we have to resend your design. We regret
any inconvenience this may cause you, but due to the nature of
email service, the many ISP companies and their decisions as
to what is considered SPAM email, web traffic as well as ISP
changes, we cannot be responsible for problems with your own
internet service. Please make sure you can receive our
emails and download before ordering.
Now the good part: Purchasing our
designs grants you a user license by which you may use the
designs in items for sale, provided the items are made by you
and not mass marketed. We define mass market as more than 250
stitch outs of the same design for sale. Please
